EMS Compact Privilege to Practice

Basic Requirements

EMS Personnel licensed in a Compact Member State (Home State) have a Privilege to Practice in all compact states (Remote State) if they meet the following requirements:
At least 18 years of age
Have a current, unrestricted license issued by a compact member state as an EMT, AEMT (or a state level between EMT & Paramedic), or Paramedic
Is practicing under the supervision of a physician medical director
 
The EMS Compact Privilege to Practice does not require an application, notification, or prior approval from either the Home State or Remote State:
It is the individual’s responsibility to ensure they meet the above requirements for the EMS Compact Privilege to Practice prior to providing care in a Remote State
It is the employer’s responsibility to ensure all EMS personnel are either licensed or have a valid Privilege to Practice
It is the employer’s responsibility to ensure compliance with EMS agency licensure regulations
EMS Providers, employers, and the public can validate a Privilege to Practice status instantly online at www.emscompact.gov with a National EMS ID Number
State EMS Officials, from Compact States, can validate EMS license and Privilege to Practice details in the National EMS Coordinated Database NEMSCD Login

Medical Direction, Rules, Complaints & Accountability

EMS Personnel operating in a Remote State are responsible for knowing and complying with all applicable laws, rules and practice requirements established by the Remote State
EMS Personnel operating in a Remote State are required to follow the scope of practice, protocols and procedures established by their Home State EMS license, physician medical
  • director and protocols OR the scope of practice, protocols and procedures established by a physician medical director in the Remote State
  • Remote States have full authority to investigate EMS Personnel, complaints and violations that occur in their state
  • Remote States have the ability to suspend, revoke or limit the Privilege to Practice for EMS personnel practicing in their state
  • Remote States shall report complaints and investigations to individual’s Home State(s) for further investigation and/or discipline
  • Home State(s) and Remote States shall report discipline and sanctions to the National EMS Coordinated Database (NEMSCD), authorized by the REPLICA legislation

Authorized Use of the Privilege to Practice

  • EMS Personnel may practice in a Remote State under a Privilege to Practice only in the performance of the individual's EMS duties as assigned by an appropriate authority, as defined in the rules of the Commission, and under the following circumstances:
    • The individual originates a patient transport in a Home State and transports the patient to a Remote State
    • The individual originates in the Home State and enters a Remote State to pick up a patient and provide care and transport of the patient to the Home State
    • The individual enters a Remote State to provide patient care and/or transport within that Remote State
    • The individual enters a Remote State to pick up a patient and provide care and transport to another EMS Compact member state

Licensure Requirements

  • Any member state may require an individual to obtain and retain a license to be authorized to practice in the member state under circumstances not authorized by the privilege to practice under the terms of the EMS Compact.
  • EMS Personnel declaring any state as their Home State are required to obtain an EMS license in that state
