Why this article addresses surplus funds
The Compact requires the Commission’s Bylaws to provide “a mechanism for winding up the operations of the Commission and the equitable disposition of any surplus funds” if the Compact were ever to dissolve (REPLICA Section 10.C.7). Article XIII is included to meet that legal requirement. It does not reflect any plan to dissolve the Compact.
The Compact also permits the Commission to levy an annual assessment on participating states (REPLICA Section 10.E.3), and state assessments are a common feature of interstate compacts. The Commission has never charged a state assessment and has no plans to do so. Because the law requires the Bylaws to address surplus funds regardless, Section 2 sets out how they would be handled: any restricted grant funds would be returned to the grantor where the grant requires it, and, as a governmental body, the Commission would return all remaining surplus funds to the participating states in good standing, in proportion to assessments paid if an assessment had ever been levied, and otherwise in equal shares.
